General FAQ's

1How do I know if I have a personal injury case?

You don’t know personal injury law like an attorney—but we do. Whether you need a dog bite lawyer, severe brain injury expert, critical illness lawyer, or more, our lawyers understand the complexities of all personal injury cases.

Call us for a free consultation, and our experienced personal injury lawyer in Hamilton & surrounding areas will assess your case. We can help you understand your rights and determine whether you have a legal compensation claim.

2What are my legal rights?

We explain your legal rights and discuss the steps you need to take to reach a fair and equitable settlement. We advise you every step of the way, ensuring you get what you deserve from both the legal system and your insurance company. The Morris Law Group has an experienced team of personal injury lawyers, Accident Benefits Consultants, and medical professionals ready to serve you.

3How do I choose a personal injury lawyer?

When choosing a personal injury lawyer or law firm to handle your case, it is important to emphasize experience, expertise, and compassionate care. The Morris Law Group has been practicing exclusively in personal injury law for more than 60 years and has earned a reputation as a leader in personal injury law. Our in-house Accident Benefits Consultants make the claims process run smoothly, and our onsite health professional ensures you and your family receive the care you deserve.

4Do I need a lawyer for a personal injury case?

While some personal injury cases can be resolved without an attorney, that route is typically only recommended if the loss and fault are clear and neither party was severely injured.

Regardless, you may want an attorney for a simpler case, and you will need one for more complex situations. An experienced medical malpractice or truck accident lawyer fully understands your legal rights and advocates to get you the settlement you deserve. An attorney can navigate settlements and represent you if the case goes to trial.

5Why should I call The Morris Law Group?

Our reputation is built on six decades of listening to clients, acting on their behalf, and tenaciously fighting for the rights of injured persons. Today, The Morris Law Group continues to operate under the same principles William Morris started with in 1960: effective listening, fair representation, and personal care. 6How do I make a personal injury claim?

Your personal injury claim begins with your first phone call to The Morris Law Group, where you talk and we listen. Lisa Morris, our new client Intake Coordinator, will take the time necessary to understand your case fully. She breaks down the legalese into terms anyone can understand and will answer the important questions such as, “Do I have a case?”, “What should I expect when filing a suit?” and “Am I ready to proceed with filing a claim?”. By the end of your very first conversation with us, you’ll know exactly where you stand and what to do next.

7Is there a statute of limitations, a time limit, or any other deadlines for making a personal injury claim?

Ontario’s statute of limitations is dependent on various factors. For example, a child may have the right to file beyond the standard limitation period.

If you don’t start the claim process within a certain time frame, your rights may be jeopardized. To avoid this possibility, contact The Morris Law Group to begin the claims process as soon as possible. If you cannot travel for whatever reason, we will meet with you in the hospital or at your home. We will review your claim with you and start working immediately.

8What will it cost me to file a personal injury claim?

You pay on a contingency basis—you only pay if you win a settlement. For example, if you are paid by the insurance company on a settlement, then we get paid. Our Hamilton accident lawyers charge no legal fees until your case settles.

9What is the average payout for a personal injury claim in Canada?

The legal process is thorough, so cases may take up to 2 to 5 years to settle, depending on the nature and complexity of your case. Keep in mind that while waiting for a settlement can be stressful, that time ensures that justice is fairly served and the integrity of the system remains.

When our personal injury lawyers review the facts of your case, we can provide you with a more accurate estimate of the length required to resolve it.

Almost sixty years later, we are still fiercely advocating on our clients’ behalf through all phases of their rehabilitation and legal claims process.

12What is an Accident Benefits Consultant?

William Morris created Accident Benefits Consultants (ABCs) in 1994 to help to guide our clients through the claims maze. From the initial filing of forms through the complicated world of benefits and assessments, ABCs take the burden off of clients by acting as their front-line advocates. They provide day-to-day assistance and information to ease the process and to make sure that everything possible is done to allow clients to access all of the benefits that they are entitled to receive. And whenever necessary, Accident Benefits Consultants assist in negotiating fair payment for benefit entitlement.

Service Specific FAQ's

1Do I need a car accident lawyer?
Do I need a car accident lawyer?

Some minor car accidents may not require legal counsel, but an experienced lawyer can often help you secure a better settlement.

You may want to hire a lawyer if:

  • You experienced any personal injuries resulting from the accident, including emotional trauma or pain & suffering.
  • The accident involved fatal casualties.
  • There is a dispute over which driver was at fault.
  • The other driver lacks insurance, or the paperwork is inaccurate.
2How much can someone sue for a car accident in Ontario?

If you’re looking to file a lawsuit for negligence, there are various damages categories you may be eligible to pursue. Civil lawsuits are compensatory, helping injured victims and their loved ones return to their position pre-accident.

There are no upper limits on these cases, but there are usually minimum thresholds, deductibles, and caps placed on payouts to ensure ample compensation that doesn’t lead to unfair cash “windfalls.”

3What are the legal obligations of property owners in slip and fall accidents?

Premises liability law holds a property owner legally responsible for slip and fall injuries that happen due to unsafe conditions. Lawmakers believe that people should hold a reasonable expectation that when they visit a property, they won’t get hurt. When an accident occurs as a result of negligent care by the property owner, victims may make a claim for damages against them.

4How long does it take to settle a personal injury claim in Ontario?

Though complex and highly-contested cases may take longer, personal injury claims in Ontario typically take around 1.5 years to settle. Don’t delay contacting a lawyer who can gather evidence ASAP and speed your case along as quickly as possible. While we can’t guarantee a particular end date, we may be able to provide a better estimate once we hear about your situation.

5If I file a personal injury claim in Ontario, will I have to go to court?

No, you do not have to go to court. Most cases are resolved outside of court. However, The Morris Law Group prepares each and every case as if it were going to trial. Because of our reputation of preparedness for court proceedings, the insurance companies are more likely to settle so that they can avoid going to trial. If, however, your case does need to go to trial, we will first give you the option of whether you would like to proceed with the case. If yes, your legal team at The Morris Law Group will work with you to make it as easy a process as possible.

6Once I file an Ontario personal injury claim, what happens next?

Our team of lawyers, Accident Benefits Consultants, and medical professionals will work hard to resolve your claim through mediation or negotiation. If a case does go to trial, our personal injury litigators will work hard to get you the results you deserve.

7Will I have to file a claim to receive long-term disability benefits?

Yes, to secure your long-term benefits, you must first file a long-term disability claim. Where you file the claim depends on your insurance, whether through your employer’s policy, a private policy, or both.

8How do I prove that my personal injury was caused due to someone else’s negligence or malpractice?

Proving negligence or malpractice is often challenging. In most cases you require properly documented evidence, expert testimony, and a lawyer experienced in the intricacies of personal injury law. The Morris Law Group has been practising personal injury law for more than 60 years and is experienced in negligence and malpractice cases. If you or a loved one has been the victim of negligence or malpractice, call us at 905-526-8080 or toll-free at 1-877-464-4466 for a free no-obligation consultation with one of our experienced personal injury lawyers. At our law firm, we work on a contingency basis, meaning that you don’t pay until your case settles.

9What does “no-fault insurance” mean?

In jurisdictions like Ontario, “no-fault insurance” allows all injured parties to seek compensation and/or accident benefits following an automobile accident regardless of who caused the accident. Past and future income loss and future medical treatments may also be claimed either from your own or the other driver’s insurance companies. Since the no-fault insurance system is so complex and because every accident is unique, it is imperative to speak to a qualified legal representative about your case as soon as possible.

The Morris Law Group has been practising personal injury law for more than 60 years and is experienced in all of the intricacies of automobile accident injuries and Ontario’s no-fault insurance system.
