Short-Term and Long-Term Disability Claims during the COVID-19 Pandemic

The information in this blog post has not been updated to accurately reflect the current trends and information related to this topic. Should you require legal advice, please contact a personal injury lawyer or certified professional for additional information and resources.

Ontarians (and all Canadians) are currently grappling with the impact of the COVID-19 Pandemic. In the workplace, many Ontarians are adjusting to new workplace procedures and the challenges of working from home. Many others have been temporarily laid-off, or have lost their jobs entirely.

If you have access to Group Benefits through your employer, you often have Short-Term Disability (“STD”) and Long-Term Disability (“LTD”) coverage available under those Group Benefits policies. In Ontario, the law requires that, in most cases, where an employer ends an employment relationship (whether through a layoff or termination) they are required to extend your benefits coverage for a certain period of time. The length of this period of time varies, and has to be determined on a case-by-case basis.

You should know that if you become ill from COVID-19, or suffered some other illness or injury either before you were laid-off or terminated, or even after your layoff or termination, that leaves you unable to work, you may be eligible to claim STD or LTD benefits.

If you have questions about potential STD and LTD claims — whether COVID-19-related or not — contact The Morris Law Group for a free consultation to answer those questions and discuss your rights.
